| Program Overview |
|
The Fireworks program carries out the requirements of Oregon Revised Statutes 480.110 through 480.165 relating to the sale and use of fireworks in Oregon. Any individual or business involved in the sale of fireworks in Oregon must first obtain a permit from the Office of State Fire Marshal (OSFM), the OSFM also issues operator certificates for those in charge of fireworks displays.

| Enforcement |

Enforcing fireworks statutes and administrative rules requires the cooperative and coordinated efforts of the OSFM and local fire and police officials. A POCKET GUIDE TO FIREWORKS ENFORCEMENT FOR FIRE AND LAW ENFORCEMENT OFFICIALS is a tool that can be used by the OSFM as well as local fire and police officials to assist in reducing fireworks related fires and injuries in Oregon. This Guide is intended as a quick reference to the policies, guidelines, and procedures which the OSFM and others use when enforcing fireworks statutes and administrative rules to assist in confiscation and storage of fireworks, inspection of retail stand/tent locations, determining types of fireworks, etc. It is not intended as a substitute for comprehensive, detailed enforcement procedures; therefore, a review of related statutes, codes, and rules is essential.

| Civil Penalties |
|
Civil Penalties may be issued for a violation(s) of Oregon’s fireworks statutes and rules. A person who violates any provision of ORS 480.110 through 480.165 and/or OAR Chapter 837, Division 12 as adopted by the State Fire Marshal is subject to a civil penalty in an amount not to exceed $500 per violation. In addition to issuing citations and penalties, the State Fire Marshal and fire authorities may confiscate any fireworks associated with the violation.
