2007 Law Change Affecting Transit Districts
Governor Kulingoski recently signed HB 3380  that amends Oregon Revised Statutes Chapter 801.206, “Commercial Motor Vehicle.” The new law amends the definition of commercial vehicle to be the same as the federal USDOT definition.
 
ORS 801.208 formerly defined certain transit vehicles owned, leased or operated under contract to a mass transit or transportation district, operated for hire, and of any size and number of passengers as “commercial vehicles.” This definition was unique to Oregon, and beyond the federal definition, which defines commercial vehicles as being 26,001 pounds or more, or designed to transport 16 or more persons including the driver. The driver of a vehicle with this description was required to have a commercial driver license with a passenger endorsement.
 
The law no longer requires drivers of mass transit or transportation districts, operating vehicles weighing 26,000 pounds or less, or carrying 15 or fewer persons including the driver, to hold a commercial driver licenses. The new law will be effective January 1, 2008.
