| Encroachment Permits |
|
This section provides information and processes permits for the state highway system.
Encroachment Permits are required for any use other than normal transportation purpose. Utility companies, developers, volunteers, nonprofit organizations desiring to place facilities or conduct various activities within state highway right of way. Such activities could include: highway construction improvements, utility installation and maintenance, highway landscaping and litter removal, commercial filming, special events such as parades, bike runs, etc.
The 2001 Legislature enacted House Bill 3068 that created the Utility Facility Permit Fee. OAR 734-055-0017establishes fees that apply to a Utility Facility permit (Schedule "A"), or permit amendment initiated by the Department (Schedule "B"), based on criteria established in the Utility Facility Permit Fee Schedules.

This brochure provides general information, provided by state and federal resource agencies, on examples of permit and clearance requirements needed for residential, industrial, commercial and public works projects in or near water. Some discussion is provided for land developments as well.
This brochure is provided to guide individuals to the agencies for verification and coordination on the need for any permit or clearances for their individual projects.
