Proposed DMV Rules
All agency rulemaking notices are published by the Secretary of State in the Oregon Bulletin. Oregon Department of Transportation (ODOT) rules must be approved by the Oregon Transportation Commission (OTC) before they can be filed with the Secretary of State and become effective. Once the public comment period has closed, the department prepares the final rule text and submits it for OTC consideration. The date of the OTC meeting at which consideration is anticipated is listed below.

Recently Closed DMV Rules

These proposals are no longer open for public comment. The Oregon Transportation Commission will consider approval of these proposed rule changes on the date listed below.
 

 Identity and Legal Presence Requirements for Driver Licenses, Permits and ID Cards
Chapter 1 of Oregon Laws 2008 requires applicants to provide proof of SSN or ineligibility for a SSN. Beginning July 1, 2008 DMV will also begin using facial recognition software to establish a person's identity.

 Release of Non-Mandatory Report Submitted to DMV
The proposed rule clarifies that a police report submitted to DMV to report a physical or mental impairment affecting driving ability or dangerous or unsafe driving behaviors is not confidential and a copy may be released to the person who is the subject of that report.

Recently Adopted DMV Rules

 Early Renewal of Driver Licenses/ID Cards for Deployed Persons
Members of the Oregon National Guard or military reservists may now renew a driver license or ID card up to 14 months prior to its expiration if the person is being deployed in defense of our country.

 CDL Waiver of Physical Disqualification for Intrastate Operations
ODOT's Motor Carrier Division previously issued a waiver to a CDL holder determined to be medically qualified under Oregon criteria. The responsibility for issuing the waivers moved to DMV last year and these amendments follow up on temporary rules reflecting the change.

 Release of a Non-Mandatory Report Submitted to DMV (temporary rule)
ODOT amended OAR 735-076-0005 to clarify that a police report that recommends a driver be retested is not confidential and a copy may be released to the person who is the subject of that report. (To be followed up with permanent rule; see proposed DMV rules above.)

 Domestic Partners
Following passage of House Bill 2007, ODOT amended its rules to allow DMV to treat a domestic partner equal to a spouse and to strengthen requirements for proof of address.

 Emergency Driver Permit
ODOT expanded the age range of persons who will be denied driving privileges following conviction of an offense involving possession, use or abuse of alcohol. The age range was 13 to 17 years, but was amended to 13 to 20 years of age. (House Bill 2147)

 New Driver License Requirements (temporary rule)
These rules implement Governor's Executive Order No. 07-22 by tightening the requirements for an Oregon driver license, permit or identification card. This rulemaking was adopted in two parts: 1) SSN verification and identity proof requirements and 2) amendments to the list of acceptable documents.
