Mission Statement
The Oregon Department of Transportation is committed to a Civil Rights Program to encourage the participation of Disadvantaged Business Enterprises (DBE´s) in contracting opportunities.

ODOT´s policy is not to discriminate on the basis of race, color, sex and/or national origin when awarding and administering those contracts.

DBE Program Objectives
  • Ensure ODOT complies with DBE laws and requirements
  • Ensure DBE's can compete fairly for U.S. DOT-funded contracts
  • Ensure that only eligible firms participate as DBE's
  • Help develop firms to compete successfully in the marketplace outside the DBE Program

The Oregon Department of Transportation recently completed a study aimed at helping Oregon small businesses who want to work on highway construction projects.

ODOT Disparity and Availability Study
In May 2005, the U.S. Ninth Circuit Court ruled that a state department of transportation could not establish a race- and gender-conscious disadvantaged business program without evidence showing that discrimination and inequity in contracting opportunities in that state’s transportation industry had occurred. The Oregon Department of Transportation, per guidance from FHWA, suspended its hard goals and retained MGT of America, Inc. to perform a comprehensive availability and disparity study. The purpose was to find out whether statistical and anecdotal evidence showed inequities had occurred in ODOT contracting and subcontracting in Oregon, and if so, for which groups.

What is a DBE?
The U.S. Department Of Transportation (U.S. DOT) regulates the DBE Program and establishes criteria for certification, which applies to DBE-eligible firms seeking contracts funded with federal transportation-related money. A DBE includes small businesses that are at least 51% owned by:
  • Women
  • Minorities: Black Americans, Hispanic Americans, Native Americans, Asian-Pacific Americans and Subcontinent Asian Americans
  • Or other individuals on a case-by-case basis

Crediting Changes to DBE Participation
The Oregon Department of Transportation is implementing changes to the Disadvantaged Business Enterprise (DBE) Program that become effective on ODOT projects with a bid opening after March 1, 2010.

Firms are required to be a certified a DBE to participate in the Disadvantaged Business Enterprise Program
