Enforcement
Successful smoke management is built on a foundation of cooperative compliance with rules governing open field burning. This compliance, however, is supported by ODA enforcement activities. ODA enforces Chapter 603 Division 77 and Chapter 837 Division 110.
 
Direct observation by inspectors, permit agents and others provides information of possible rule infractions. The number of enforcement personnel active in investigations fluctuates according to burning activity and areas to be covered. Radio and cell phone communications facilitate the vital coordinating function among those actively involved in investigating possible rule infractions during burning periods.
 
ODA staff evaluates the factors involved in each case and the director of the Oregon Department of Agriculture may assess civil penalties.
