| Adopted New and Amended Administrative Rules |
|
On March 13, 2009, the Land Conservation and Development Commission (LCDC) adopted new and amended administrative rules concerning urban growth boundaries (UGBs).
The new and amended rules clarify requirements regarding the adoption and amendment of UGBs; provide "safe harbors" intended to reduce local government time and cost in amending a UGB; and clarify procedures for LCDC review of UGBs in the manner of periodic review under ORS 197.626.
The new and amended rules were filed with the Secretary of State on April 8, 2009, and took effect April 16, 2009.

| Proposed Administrative Rules and Rule Amendments |

The Land Conservation and Development Commission (LCDC) is considering the adoption of new and amended administrative rules to clarify and streamline the UGB amendment process and reduce costs to local governments. These proposed new and amended rules are under OAR chapter 660, division 24.
LCDC will hold a public hearing to consider the proposed new rules at its meeting in in Salem on Thursday, March 12 (Agriculture Building, 635 Capitol Street NE). The meeting, which includes other agenda items, will begin at noon.
Interested persons may testify during the public hearing regarding the proposed new and amended rules, and/or submit written comments by providing 20 copies to the Commission Assistant.
Written comments are encouraged and may be submitted prior to the public hearing as described below. LCDC will accept testimony, including written comments, until the close of the public hearing. However, to be provided to LCDC in advance of the meeting, written comments (one copy is sufficient in this case) must be received at DLCD's Salem office by 5 p.m. on Monday, February 23, 2009.

The Land Conservation and Development Commission (LCDC) is considering the adoption of new and amended administrative rules to clarify and streamline the Urban Growth Boundary (UGB) amendment process and reduce costs to local governments.
These proposed new and amended rules will be codified under OAR chapter 660, division 24. LCDC may consider additional provisions by interested persons or DLCD during the public comment period.
The proposed rules are below, along with the required rulemaking information:
LCDC will hold a public hearing to consider the proposed new rules at its meeting in Tillamook on Thursday, December 4 (Tillamook County Library, 1716 3rd Street). The meeting, which includes other agenda items, will begin at 8:30 a.m. (Link to LCDC reports for Dec. 4, 2008 meeting in Tillamook.)
Interested persons may testify during the public hearing regarding the proposed new and amended rules, and/or submit written comments by providing 20 copies to the Commission assistant.
Written comments may also be submitted prior to the public hearing as described below. LCDC will accept testimony, including written comments, until the close of the public hearing. However, written comments to be provided to LCDC prior to the meeting (one copy is sufficient in this case) must be received at DLCD's Salem office by 5 p.m. on Friday, November 28, 2008.

| Background |

On June 19, 2008, the Land Conservation and Development Commission (LCDC) directed the department to continue policy work toward streamlining the Urban Growth Boundary (UGB) amendment process, initiating “Phase 2” of an ongoing project that had begun in 2004. The commission also appointed a work group to guide this project, described below.
LCDC initiated the first phase of this project in 2004, including a work group to guide that effort. Based on recommendations from that work group, LCDC adopted amendments to Statewide Planning Goal 14: Urbanization in 2005, and a new set of administrative rules interpreting the goal, OAR 660, Division 24 in 2006. When it adopted the new rules in 2006, LCDC directed the department to continue working on elements of these rules during the 2007-09 biennium, including ideas that had been discussed but not adopted as part of Phase 1.
The Phase 2 work group proposed additional amendments to the UGB rules in the fall of 2008. After a public hearing on these proposals, the work group continued to meet and proposed a final recommendation in January 2009. LCDC held a second public hearing on this recommendation, and adopted the new and amended administrative rules on March 13, 2009.
