| If you Filed a Measure 37 Claim With the State of Oregon... |

On November 6, 2007, Oregon voters approved Measure 49, which modifies Measure 37 (2004). Measure 49 took effect on December 6, 2007.
If you already have an approved claim under Measure 37, you will receive information from the Department of Land Conservation and Development (DLCD) about your options under Measure 49. If you choose to proceed under Measure 49, and you meet the standards in the law, the state will authorize a specific number of home sites to be developed on your property. This authorization will be in the form of an order, which will replace your Measure 37 order.
If you have a pending state Measure 37 claim and you haven’t received an order yet from the state, you do not have to submit a new claim. You will receive a notice from DLCD regarding the impact of Measure 49 on your claim and your options to proceed under Measure 49. Notices will be sent January through April 2008.
If you previously received a decision from the state denying your claim under Measure 37, you may still be eligible to submit application for home site authorizations under Measure 49. DLCD will send all Measure 37 claimants information about current options under Measure 49, except to those who have withdrawn their claim.
If you have started or completed the use that was authorized by a state Measure 37 order, you may have the right to continue that use if your use of the property complies with the waiver, and you have a common law vested right to complete and continue the use.

This claims registry was maintained by the Department of Administrative Services (DAS) during the Measure 37 implementation process and was the means for providing public notice of claims filed with the state through Dec. 5, 2007.
Claims received on Dec. 6, 2007, and forward, will be received by DLCD (DAS will no longer receive claims). New Measure 49 claims will be added by DLCD to this registry, or a new registry, as the information is available.
