Business Energy Tax Credit Waiver Letters
 
Business owners should apply for a Business Energy Tax Credit prior to beginning their projects, purchasing equipment, or signing contracts. At times, extenuating business circumstances cause the project start date to precede the application receipt date at the Oregon Department of Energy office. In such case, business owners may include a waiver letter with their completed application explaining the extenuating business circumstances. If accepted, the Department will continue to review and process the application. If not accepted, the Department will notify the business owners in writing. Following are some tips in submitting your waiver letter:
 
• The project start date should be within 90 days of the application date. If the project start date is more than 90 days before the application receipt date, the Director of the Department of Energy may approve the waiver request under extraordinary circumstances.

I am requesting a waiver of the requirement to apply for the Business Energy Tax Credit prior to starting my project. I started my project on (date). My application is included with this letter. I had to start my project before submitting my application for the following reason: (some acceptable examples follow)
  1. My current equipment malfunctioned and had to be replaced immediately to continue production.
  2. The vendor notified me of a pending price increase unless equipment was ordered immediately.
  3. I had a vacancy in my rental unit and wanted to complete the project while I had the opportunity.
  4. I needed to have my frost-protection equipment in place before the first freeze.
  5. Other (We will evaluate on a case-by-case basis.)

• A completed application must accompany the waiver letter. Some examples of unacceptable reasons include:
 
1. I forgot to complete the application before I started the project because I was busy (I was on vacation, my assistant didn’t send it in, it got lost on my messy desk, etc.).
 
2. I didn’t know about the tax credit until after I started the project.
