Updated Wetland Delineation Report Guidance with Examples
 
DSL, the Portland District Corps of Engineers, and EPA Region 10 have updated our wetland delineation report guidance. The document clarifies state and federal requirements, includes hints for difficult situations, explains agency practice, and provides many examples.  This guidance is a supplement to the 1987 Corps Wetlands Delineation Manual , and DSL administrative rules governing delineation reports. Guidance
Handling stormwater during construction
  1. An NPDES permit (1200 C) is required from DEQ to handle stormwater during construction projects that disturb 1 acre or more. If requested by DEQ during our public notice period, we will condition our permits to require an NPDES permit prior to construction.
     
  2. We will continue to require a description of BMP´s to be used during construction to keep any sediment from getting into waterways and wetlands during construction.

Handling post construction stormwater
  1. A Stormwater Management Plan is required for all projects that result in new impervious surfaces.
     
  2. If the project is located within one of the MS4 permitted cities, and all stormwater will be discharged to the municipal treatment system, a letter from the local government accepting the amount and methods of handling stormwater is sufficient.
     
  3. If the project is within a local jurisdiction that does not have an MS4 authorization (or if you are not discharging the stormwater into the municipal treatment system), DEQ will request a Stormwater Management Plan during our public review process. You may wish to include the plan in your removal/fill permit application or we can condition our permits to say that an approved Stormwater Management Plan is required prior to beginning construction.

Irrigation Diversion
 
DSL has received legal advice on replacement of push-up dams with lay-down diversion structures. In general, replacement structures do not require a permit if they affect less than 50 cubic yards and if the purpose of the work relates to an activity customarily associated with agriculture (except in State Scenic Waterways, where a permit IS required). A memo provides details.
 
NOTE: The same provisions apply to new irrigation diversions as well as replacement structures. Therefore, a NEW lay-down diversion structure is allowed without a permit if the work involves less than 50 cubic yards and is related to an activity customarily associated with agriculture (except on a State Scenic Waterway).
