Inclusion of Domestic Partner in the Definition of Immediate Family for Inmates Assigned to Disciplinary Segregation
The temporary rule amendment is necessary to modify the rule to comply with HB 2007 (Oregon Family Fairness Act). This will permit inmates assigned to disciplinary segregation to visit with their domestic partner, as well as other immediate family members.

Marriages or Domestic Partnership Solemnization Ceremonies for Inmates in DOC Facilities
The temporary amendments are necessary to modify the rules to comply with HB 2007 (Oregon Family Fairness Act) and permit inmates who had entered into a domestic partnerhip to participate in a solemnization ceremony in a DOC facility.

Inclusion of Domestic Partner in the Definition of Immediate Family for Inmate Visitation, and Clarification for Visitation of Inmates in Administrative Housing.
The temporary amendments are necessary to modify the rule to comply with HB 2007 (Oregon Family Fairness Act) and clarify visiting policies for inmates in Administrative Housing. Amendment to OAR 291-127-0010 will permit inmates in certain special housing units and on basic visiting status to visit with their domestic partner, as well as other immediate family members. Amendment to OAR 291-127-0260 will permit inmates assigned to Administrative Housing to visit with approved visitors on the inmate's visiting list.

Security Threat Management
These rule amendments are necessary to establish DOC policy and procedures for the identification and management of individual inmates and groups of inmates that in the judgment of the Department present an elevated security threat risk based on their criminal history, institutional conduct history, present behavior, interstate transfer status, escape history, and based on intelligence.

Assessment, Assignment and Supervision of Inmates for Work Assignments and Unfenced Minimum Housing
The Department has established new criteria for determing an inmate's eligibility for assignment to community custody work crews, on-site work assignments and unfenced minimum housing. These temporary rule amendments are necessary to implement the new criteria.

Classification System for Assigning Custody Level to Inmates
These changes are necessary to fully implement the Department's new classification system for assigning inmates with the appropriate custody classification level. All inmates have been assigned under the new classification system. Additional changes are necessary to provide clarification for scoring the custody classification guide and to reflect operational changes within the agency.

Prohibited Inmate Conduct and Processing Disciplinary Actions
The rule modifications are necessary to update and clarify the standardized process for handling inmate misconduct in DOC facilities. The amendments expand the time an inmate may be ordered loss of leisure activities to address misconduct from 24 hours to 72 hours; define the parameters for calculating restoration of earned time credits or statutory good time as a result of adjustments to the final order for an inmate's significant positive behavior changes; and require inmates to use a specific department form when filing a petition for administrative review to the Inspector General.

Victim Services Program
Adoption of these temporary rules is necessary for the Department to establish the Victim Services Program which includes a victim/inmate facilitated dialog program, and the policies and procedures for the conduct and administration of the program.

Substance of Abuse Urinalysis Testing of Inmates in DOC Facilities
Amendment and repeal of these temporary rules is necessary to update the criteria and methodology by which urine samples of inmates incarcerated in Department facilities are collected and tested for substances of abuse. The new methodology will increase the number of substances tested. Other changes are necessary to update terminology and reflect operational changes within the Department.

Inmate Trust Accounts
These temporary rule amendments are necessary in order to clarify and conform the DOC rules to reflect the Department's historical policy and practice to assess inmate trust accounts for court-ordered costs and fees in judicial review proceedings, in habeas corpus and post-conviction cases, in tort actions against a public body, and in other proceedings as authorized or required by law. The Department intends that these temporary rule amendments apply retroactively to assessments made by the Department against an inmate's account for these purposes prior to, on, and after the effective date of the rule amendments.

Administrative Housing
Modifications of these rules are necessary to clarify and update requirements for placing an inmate in administrative housing for purposes of protective custody, involuntary protective custody and administrative segregation, and to establish an administrative review process for such placements. Inmates will not be assigned to administrative housing for these purposes without review and approval of the Special Population Managmenet Committee.

Incoming Mail Services for Inmates Incarcerated in Department of Corrections Facilities
This amendment will permit inmates incarcerated in DOC facilities to received used books directly from the publisher or distributor through the inmate mail system.
