Legal and Policy Requirements for Disaster Reponse
Program Requirements
State agencies are required to develop, test, and maintain business continuity plans. 

 

DAS Business Continuity Plan Policy, July 27, 2009  This policy sets forth guidelines requiring all State of Oregon agencies, individually, and in conjunction with other agencies, to develop, implement, test, and maintain Business Continuity Plans (BCP).


Legal and Policy Requirements for Disaster Reponse
While business continuity planning relates to recovering from a disaster, there are also statutory and policy requirements relating to immediately responding to a disaster at the time one occurs.
 

Government Roles During an Emergency
ORS Chapter 401 deals with the responsibilities of state and local governments to respond to emergency situations.  The chapter addresses topics such as the governor’s ability to declare an emergency, the Office of Emergency Management, the Oregon Homeland Security Council, and the responsibilities of state and local governments during an emergency situation.

Office of Emergency Management
ORS 401.257 to 401.325 describes the roles and responsibilities of the Office of Emergency Management.  The office is responsible for coordinating private sector and governmental efforts to prepare for, respond to and recover from emergencies.  The office also coordinates training, planning, response, and mitigation activities with state and local emergency services agencies and organizations.
OregonHomeland Security Council
ORS 401.881 creates the Oregon Homeland Security Council within the Office of Emergency Management. The council shall receive briefings on security matters from state agencies and organizations as determined by the council.  The council shall also advise state agencies with responsibility for security matters on the future direction of the office’s planning, preparedness, response and recovery activities.
Emergency Procurements
Oregon Administrative Rule (OAR) 125-247-0280 addresses the emergency procurement process.  This rule describes when an agency may award a contract to purchase goods and services during an emergency.  The rule states that procurement must be made with competition that is practicable under the circumstances.  The rule outlines the process to follow when purchasing during an emergency.

Oregon Emergency Response System    
Executive Order No. 01-24 established new roles for the Oregon Emergency Response System (OERS).  The purpose of OERS is to coordinate and manage state resources and cooperate with all levels of government and the private sector in the event of an emergency.  OERS is the primary point of contact by which any public agency provides the state notification of an emergency or disaster, or requests access to state or federal resources.
